TERMS AND CONDITIONS OF HIRE
1. General Statement
Tripax Ltd operates under an Operator’s Licence as per the Department of Transport regulations. Our fleet complies with all necessary licensing and roadworthiness standards. All drivers employed by Tripax Ltd are fully qualified and competent to operate company vehicles.
2. Definitions
2.1 “Terms” refers to the conditions outlined herein under which the Company provides vehicle hire services.
2.2 “Company” refers to Tripax Ltd trading as Tripax Ltd.
2.3 “Client” refers to the individual, organisation, or agent entering into an agreement with the Company.
2.4 “Passenger” refers to any individual transported by a Company vehicle.
2.5 “Booking” refers to the Client’s formal request for the Company’s services.
2.6 “Tariff” refers to the fixed pricing structure set by the Company for Clients.
2.7 “Hire Price” refers to the agreed fee for vehicle hire for a Client who does not hold an Annual Agreement.
2.8 “Private Hire” refers to a one-off booking of a vehicle by a Client.
2.9 “Contract” refers to the legally binding agreement between the Company and the Client.
2.10 “Regulations” refers to the governing framework of British Domestic or European Community Regulations.
2.11 “Tachograph” refers to the system that records journey time, speed, distance, and driver rest periods.
3. Insurance
3.1 Clients must ensure all passengers have adequate travel insurance before using the Company’s services.
3.2 The Client’s insurance must indemnify the Company against any claims outside the Company’s control.
3.3 The Client is responsible for losses arising from their own negligence, agents, or representatives.
3.4 The Company accepts personal belongings on a reasonable care basis but does not accept liability for loss or damage.
3.5 Clients should notify the driver or the Company if they intend to carry valuable items. Responsibility for unattended items remains with the Client.
4. Contract Terms
4.1 These terms apply whether the contract is agreed verbally or in writing. The hirer represents all passengers.
4.2 The Client must provide full details of hire requirements in writing.
4.3 The Company acknowledges the request in writing and confirms the agreed price.
4.4 Quotations are based on the most direct route unless otherwise specified by the Client.
4.5 Quotations remain valid for 28 days unless otherwise stated.
4.6 Hire costs cover only vehicle and driver unless additional costs are specified separately.
4.7 The Company reserves the right to impose fuel surcharges if necessary.
4.8 Any last-minute changes by the Client must be in writing and are subject to availability.
4.9 The Client is responsible for ensuring all passengers board on time. The Company is not liable for those who fail to comply.
4.10 No advertisements or notices may be placed in Company vehicles without prior written permission.
5. Cancellation Policy
5.1 Cancellations must be in writing.
5.2 Cancellations 14 days before travel incur no charge.
5.3 Cancellations within 13 days of travel incur a 50% charge of the total hire cost.
5.4 Cancellations within 48 hours of travel incur a 100% charge.
5.5 Additional costs for non-refundable expenses (e.g. accommodation, tickets) will be charged.
5.6 Cancellations due to adverse weather conditions are charged as per the terms above.
5.7 In exceptional circumstances beyond the Company’s control (e.g. strikes, extreme weather), the Company reserves the right to cancel services with a full refund.
6. Payment Terms
6.1 Full payment is required before the journey.
6.2 Clients with annual agreements are invoiced daily, weekly, or monthly.
6.3 Ad hoc hires must be paid upfront.
6.4 The Company reserves the right to charge for additional mileage or delays caused by the Client.
7. Service Provision
7.1 The Company determines the route unless otherwise agreed.
7.2 The driver has the final say on the safest route.
7.3 The Company is not liable for delays beyond its control.
7.4 The vehicle is only available for use as agreed in the contract.
7.5 The Company may provide a different vehicle of equal or higher standard if required.
7.6 The driver is responsible for luggage storage. Items cannot obstruct emergency exits or aisles.
7.7 Any property left on the vehicle is kept for 14 days.
7.8 The driver may refuse carriage to any individual whose behaviour threatens safety.
8. Safety and Conduct
8.1 Emergency procedures are displayed on all vehicles.
8.2 Clients should ensure passengers are familiar with emergency exits.
8.3 Passengers with special requirements must notify the Company in advance.
8.4 The Company will replace a vehicle in the event of a breakdown.
8.5 The Client is responsible for maintaining orderly conduct of passengers.
9. Alcohol, Food, and Drugs
9.1 Alcohol consumption is not permitted on Company vehicles travelling to football matches.
9.2 The driver has discretion to allow alcohol consumption at other times.
9.3 Food consumption is discouraged unless the vehicle is specifically designed for such use.
9.4 The use or possession of illegal drugs is strictly prohibited.
10. Quality Assurance and Complaints
10.1 The Company implements strict quality control measures.
10.2 Complaints should be reported to the driver at the time of service. If unresolved, written complaints must be submitted within 14 days of hire.
11. Liability and Force Majeure
11.1 The Company is not liable for any claim unless substantiated through formal arbitration.
11.2 The Company accepts no liability for unforeseen events, including acts of terrorism or natural disasters.
11.3 Legal disputes will be governed under the laws of England and Wales.
12. General Provisions
12.1 Any changes to the contract must be agreed in writing.
12.2 Any disputes will be resolved within the jurisdiction of the English courts.
By confirming a booking with Tripax Ltd, the Client agrees to these Terms and Conditions.
